"Tuscany Bike Tours" (Part 1 of 2)

The company Active Tours Italy S.r.l. organizes bike tours and vespa/scooter tours in the city of Florence and in the Chianti region, in eleven programs called “Tuscany Bike Tours”, “Tuscany Vespa Tours”, “Tuscany Sunset Bike Tour”, Tuscany Sunset Vespa Tour”, “Chianti to San Gimignano Bike Tour”, “Chianti to San Gimignano E-Bike Tour”, “San Gimignano Bike Tour (soft)”, “Chianti Classico E-Bike Tour”, “Discover the Via Francigena and San Gimignano on an E-Bike”, “The best of Chianti Classico E-Bike Tour” and “Florence City Bike Tours” between March through November (based on the administrative authorization provided by the Florence local authority as formally declared on 06/05/2010).

Participation is subject to the acceptance by the client to the following terms and conditions:

For the “Tuscany Vespa Tour”, a valid driver’s license is required (a motorcycle drivers license is not required). Minimum 18 years of age. To participate on our scooter tour prior experience is advantageous and highly recommended. Please be aware that we are not a scooter learning driving school. We reserve the right to deny any participant taking part or continuing the scooter tour if we feel the participant is unable to operate the scooter safely. Our decision is final. No refunds are offered. If at any point a participant cannot operate his/her scooter safely, One can ride as a passenger with their partner or with the guide (if available). No Refunds for difference in price is offered. An expired driver license will not be accepted and will be considered as a no show. Full payment will be incurred in this case.

For the “Florence City Bike Tours” the child policy is a minimum age of 15 years old. No expectant mothers please.

Excursion

  1. The company Active Tours Italy S.r.l. provides clients with bicycle, scooter/vespa and helmets that will be delivered in perfect working condition and which must be returned by the client in the same condition at the end of the excursion.
  2. Participants will be accompanied during the excursion by Italian or English speaking tour escorts.
  3. The price for the excursion amounts to (taxes inclusive, payment can be made at the moment of signing this Agreement):
    • Tuscany Vespa Tours: €140.00 per person or €130.00 per student. Passenger €95.00 (valid id required). Full time students under 26.
    • Tuscany Bike Tours: €95.00 per person or €85.00 per student (valid id required). Full time students under 26.
    • Tuscany Sunset Vespa Tour: €130.00 per person. Passenger €95.00.
    • Tuscany Sunset Bike Tours: from €145.00 per person.
    • Chianti to San Gimignano Bike Tour: from €220.00 per person.
    • Chianti to San Gimignano E-Bike Tour: from €255.00 per person.
    • San Gimignano Bike Tour (soft): from €220.00 per person.
    • Chianti Classico E-Bike Tour: from €255.00 per person.
    • Discover the Via Francigena and San Gimignano on an E-Bike: from €245.00 per person.
    • The best of Chianti Classico E-Bike Tour: from €245.00 per person.
    • Florence City Bike Tours: from €52.00 per person.
  4. If bookings do not reach the minimum number of participants, the service as defined within this agreement will not be provided and any deposit that has been made by the client will be refunded. In the event of a full refund 3.2% plus €0.39 per ticket will be withheld as it is a non refundable transaction fee charged by Regiondo and Stripe at the time of booking.
  5. The excursion will not take place in the case of adverse weather conditions or extraordinary events. In each of these cases, the company Active Tours Italy S.r.l. withholds the right to use its own discretion when evaluating the appropriateness of excursions. In such cases, no refund will be applicable to the customer.
  6. In the case of the cancellation of an excursion, for reasons other than those provided in the preceding two paragraphs, the customer is entitled to a refund of the amount paid (3.2% plus €0.39 per ticket will be withheld as it is a non refundable transaction fee charged by Regiondo and Stripe at the time of booking), or, if the client so decides, the client will be entitled to participate in one subsequent excursion scheduled in the following seven days after the cancellation. The replacement excursion will be of equivalent value and duration. Should the client decide to participate in a substitute trip, they will renounce any refund claims that they were initially entitled to.
  7. Participants of the excursion affirm that they are entirely responsible for their own actions, and that any claim for damages to the company Active Tours Italy S.r.l. are waived. In particular, clients declare that:
    • they are able to ride a bicycle/scooter safely;
    • they are of good health;
    • they know the Italian Highway Rules.
  8. Participants must be present at the agreed excursion meeting point 30 minutes before departure. No refund will be provided to the individuals that are not present at the agreed meeting time and place and no refund will be provided to those that lose contact with the group guide or in the case that they do not complete the excursion. A no show will incur full cost.
  9. Participants must provide the organization with a valid ID (passport, identity card and visa and health certificates should they be so requested).
  10. Participants in the excursion are required to practice common sense, prudence and diligence, particularly in relation to the equipment provided by the company during the excursion, of which the participants agree to use at their own risk. Participants have the right to take out and purchase personal insurance to cover potential damages to their person, third parties or equipment (personal insurance is recommended).
  11. Active Tours Italy S.r.l. waives all claims for damages made against them, and accepts no liability for any damage to the participant, third parties and equipment caused during excursions.
  12. The organization does not assume responsibility for loss of baggage, money, valuables or other items during the trip.
  13. Participants will be held responsible for any damage to the equipment provided to them by the company Active Tours Italy S.r.l.
  14. Participants are liable for all damages that the Active Tours Italy S.r.l. may endure due to the failure to comply with the above mentioned obligations.

Under Articles. 1341 and 1342 of the Civil Code, the client expressly accepts the following points:

PROPOSAL OF AGREEMENT ( Part 2 of 2)

The Company ACTIVE TOURS ITALY S.r.l., based in Florence, Via Ghibellina No.34/r, in its legal representative pro tempore (tax payer's code 06053470487).

PROVIDES THE FOLLOWING SERVICES

  1. The preliminary part to this agreement, as signed by the parties, form an essential and integral part of this document.
  2. The company Active Tours Italy S.r.l. organizes bike tours and vespa/scooter tours in the city of Florence and in the Chianti region, in eleven programs called “Tuscany Bike Tours”, “Tuscany Vespa Tours”, “Tuscany Sunset Bike Tour”, Tuscany Sunset Vespa Tour”, “Chianti to San Gimignano Bike Tour”, “Chianti to San Gimignano E-Bike Tour”, “San Gimignano Bike Tour (soft)”, “Chianti Classico E-Bike Tour”, “Discover the Via Francigena and San Gimignano on an E-Bike”, “The best of Chianti Classico E-Bike Tour” and “Florence City Bike Tours” between March through November (based on the administrative authorization provided by the Florence local authority as formally declared on 06/05/2010).
  3. The reservation request must be made on the provided electronic contract form, fully accepted or signed by the customer. Acceptance of a reservation shall be considered complete when the client receives confirmation of acceptance of the parts from Active Tours Italy S.r.l. Confirmation may also be provided through electronic means.
  4. Services described in pact No.1 will be provided in date mm/dd/yyyy.
  5. The fee for the service offered by the Company Active Tours Italy S.r.l. amounts to (taxes inclusive, payment can be made at the moment of signing this Agreement)
    • Tuscany Vespa Tours: €140.00 per person or €130.00 per student. Passenger €95.00 (valid id required). Full time students under 26.
    • Tuscany Bike Tours: €95.00 per person or €85.00 per student (valid id required). Full time students under 26.
    • Tuscany Sunset Vespa Tour: €130.00 per person. Passenger €95.00.
    • Tuscany Sunset Bike Tours: from €145.00 per person.
    • Chianti to San Gimignano Bike Tour: from €220.00 per person.
    • Chianti to San Gimignano E-Bike Tour: from €255.00 per person.San Gimignano Bike Tour (soft): from €220.00 per person.
    • Chianti Classico E-Bike Tour: from €255.00 per person.
    • Discover the Via Francigena and San Gimignano on an E-Bike: from €245.00 per person.
    • The best of Chianti Classico E-Bike Tour: from €245.00 per person.
    • Florence City Bike Tours: from €52.00 per person.
  6. The customer may recede from this agreement by providing written notice more than three days prior to the date cited in the pact No.4, in which case no cancellation fee will be applied (3.2% plus €0.39 per ticket will be withheld as it is a non refundable transaction fee charged by Regiondo and Stripe at the time of booking).
  7. In the event that the client recedes from this agreement within 3 days before the date specified in the pact No.4, no notice will have been deemed to have been given, the Company will charge the entire amount paid and this agreement shall be automatically terminated.
  8. If bookings do not reach the minimum number of participants, the service as defined within this agreement will not be provided and any deposit that has been made by the client will be refunded. In the event of a full refund 3.2% plus €0.39 per ticket will be withheld as it is a non refundable transaction fee charged by Regiondo and Stripe at the time of booking.
  9. The excursion will not take place in the case of adverse weather conditions or extraordinary events. In each of these cases, the company Active Tours Italy S.r.l. withholds the right to use its own discretion when evaluating the appropriateness of excursions. In such cases, no refund will be applicable to the customer.
  10. In the event that before the departure the organizer communicates in writing his unwillingness to provide the services under this contract and proposes an alternative solution, the customer can either exercise the right to be entirely refunded (3.2% plus €0.39 per ticket will be withheld as it is a non refundable transaction fee charged by Regiondo and Stripe at the time of booking) or decide to join an alternative service. The customer may exercise these rights even when the cancellation depends on the failure to achieve the minimum number of participants described in the preceding paragraph.
  11. Participants in the excursion are also required to practice common sense, prudence and diligence, with particular reference to the equipment provided by the company during the excursion, of which the participants agree to use at their own risk. Participants have the right to take out and purchase an insurance policy to cover potential damages to their person, third parties or equipment.
  12. Active Tours Italy S.r.l. waives all claims for damages made against them, and accepts no liability for any damage to the participant, third parties and equipment caused during excursions.
  13. The organization does not assume responsibility for loss of baggage, money, valuables or other items during the trip.
  14. Participants will be held responsible for any damage to the equipment provided to them by the company Active Tours Italy S.r.l.
  15. Participants of the excursion affirm that they are entirely responsible for their own actions, and that any claim for damages to the company Active Tours Italy S.r.l. are waived. In particular, clients declare that:
    • they are able to ride a bicycle/scooter safely;
    • they are of good health;
    • they know the Italian Highway Rules.
  16. The parties agree that any dispute that may arise out of the interpretation or the application of this Agreement must be resolved exclusively by the Court of Florence. Any other court of law is expressly waived.
  17. Participants must provide the organization with a valid ID (passport, identity card and visa and health certificates should they be so requested).
  18. Participants in the excursion are required to practice common sense, prudence and diligence, particularly with reference to the equipment provided by the company during the excursion.
  19. Participants are liable for all damages that the Active Tours Italy S.r.l. may endure due to the failure to comply to the above mentioned obligations.
